Lawyer in Kenyatta Family Land Case Now Under Investigation

A lawyer who is said to have acted on behalf of two of President Uhuru Kenyatta's cousins in a Sh3 Billion land suit is now being investigated by the police.

Lawyer Gideon Kaumbuthu Meenye is being investigated in connection with a disputed consent note that led to the sale of the disputed land.

The President's cousins, Rt. Captain Kung'u Muigai and former Gatundu legislator Ngegi Muigai, denied claims that they had instructed the lawyer to issue the Kenya Commercial Bank (KCB) with the consent to sell the land.

In a letter to the Inspector General of Police Joseph Boinnet, the lawyer asked the police boss to launch investigations into the document which he claims he did not issue.

"Cause an inquiry into the allegations that I acted for Benjoh, as it is obvious that someone is playing some mischief. The allegations are impacting on me negatively," his letter read in part.

He reiterated that he had not been contracted to act on behalf of the two brothers, therefore, the document should not have been admitted by the court.

"I did not execute the said agreement nor could I possibly have done so since I was not the advocate on record, had not been instructed by advocates on record to hold brief nor had I been instructed by Benjoh/ Muiri to appear and or represent them in the said case," he reiterated.

KCB auctioned off the 443-acre Muiri Coffee Farm in Thika to Bidii Kenya Limited in 1998 to recover an alleged Sh70 Million loan which the brothers contested.

Court of Appeal Judges Roselyn Nembuye, Milton Makhandia and Kathurima M'inoti enforced the order in December 2017 when Bidii was given authority to occupy the land.  

In 1998, the then Court of Appeal Judges Philip Tunoi and Samuel Bosire used the controversial consent order to give KCB leeway to auction the land.

The two members of the Kenyatta family are now relying on the police report on the letter to appeal the 2017 ruling.
