Judge George Odunga Summons CS Fred Matiang'i Over Miguna Detention

High Court Judge George Odunga has ordered Interior Cabinet Secretary Fred Matiang'i to appear in person at the Milimani Law Courts at 2:30 p.m. on Wednesday.

Justice Odunga issued the mandatory summons in connection with proceedings over the detention of lawyer Miguna Miguna at the Jomo Kenyatta International Airport (JKIA) since Monday.

In connection with the summons, Immigration Principal Secretary Gordon Kahalangwa, Inspector General Joseph Boinnet and the Attorney General were ordered to ensure that they appear as well.

The law enforcement bosses were also ordered to produce the embattled lawyer at the afternoon hearing, without fail.

"Mr Mutinda I will not accept affidavits or people coming to stand here in their place. They have to appear before me at 2.30pm in person," the Judge warned the lawyer representing the government, Charles Mutinda.

The Judge also allowed an application by the Law Society of Kenya to be enjoined in the petition filed by Miguna through lawyers Cliff Ombeta, James Orengo and John Khaminwa.

"The matter is of great public interest so LSK should be part of the case," the Judge ruled.

When the Judge sought clarification on why Miguna was not presented in court following a Tuesday order, State counsel admitted that Miguna was being held at the JKIA.

The petitioner's lawyers further argued that he was being held incommunicado (denied communication with others) and in deplorable conditions.

They further urged Justice Odunga not to allow the government to continue to detain the Opposition leader while citing various precedents set by other courts of the world.
