Court Makes Interesting Ruling on Man Caught Stealing Spoons

There was an interesting case at a Mombasa Court on Thursday after a man admitted to stealing 108 spoons from Uchumi Supermarket.

Senior Resident Magistrate Edgar Kagoni, however, released the suspect on grounds that he had requested to go and bury his mother.

"I have considered the accused person mitigation and considering that all the spoons have been recovered, I discharge him under section 35 of the Criminal Penal Code," he remarked.

Theophilus Mutunkei Sakaya admitted that he stole the spoons but did not tell the court his motive.

"I plead for leniency. While in custody I was told that my mother passed away. I plead with this court to release so that I can go and bury my mother.

"I will not repeat the offence," he pleaded with the court.

Elsewhere, a 13-year-old girl has told the court that she was defiled by a police constable inside a police cell on September 30, 2017.

The minor, who is under the care of the Witness Protection Agency, stated that Laban Njogu sexually assaulted her at Murang’a Police Station while promising to release her unconditionally.

She told Murang’a Principal Magistrate Antony Mwicigi, who had visited the police station, that Njogu did not honour his promise after defiling her.

“The officer knocked the door of my cell before he opened it and demanded sex while promising to facilitate my release without any conditions," she was quoted by the Standard.
