Looming Showdown Ahead of Miguna’s Return on May 16

A showdown is looming between the government and controversial lawyer Miguna Miguna who insists will be returning to the country on Wednesday, May 16.

In a letter to the Kenya National Commission on Human Rights (KNCHR), Immigration Principal Secretary Gordon Kihalangwa maintained that Miguna must apply afresh to regain his Kenyan citizenship.

Kihalangwa further stated that his department will not issue Miguna with a Kenyan Passport since he has not applied for one.

The Immigration PS also noted that the government will not purchase a flight ticket for the lawyer as demanded by his legal team, insisting that the court did not issue an order to that effect.

KNCHR had asked the government to buy a flight ticket for the self-declared National Resistance Movement (NRM) general ahead of his return to Kenya.

The national rights watchdog also wanted the government to issue the deported lawyer with a valid Kenyan passport to facilitate his comeback to the country.

On Sunday, the government reiterated its position that Miguna is not a Kenyan citizen and he will only be allowed into the country using his valid Canadian passport.

According to Miguna’s lawyer Cliff Ombetta, the government had not given any assurance in regard that the lawyers return.

Miguna via his social media stated: “I am returning to Kenya on May 16, 2018. I am a Kenyan citizen by birth. The High Court has ordered CS Fred Matiang'i, Gordon Kihalangwa, Joseph Boinnet and Kinoti 13 times to issue me with a valid Kenyan passport and facilitate my return to Kenya as a Kenyan unconditionally.”

In a hard-hitting judgement that sent a warning to State officials disobeying court orders, Justice Luka Kimaru ruled the decision to declare Miguna a non-Kenyan citizen and his subsequent deportation were null and void.
