Senior Magistrate Goes Missing in Unclear Circumstances

The Kenya Magistrates and Judges Association (KMJA) has raised alarm after Malindi Senior Resident Magistrate went missing in unclear circumstances. 

Justice Corilus Osero Nyawiri is said to have been driven away from Malindi by people alleged to be officers from the Ethics and Anti-Corruption Commission (EACC).

After the Wednesday, May 23, 2018 incident, the Senior Magistrate was expected to be arraigned at Milimani Law Courts, Nairobi the next day.

According to KMJA, the officers who whisked Osero away had indicated that he will be charged with suspicion of corrupt deals.

The Judges Association on Thursday wrote to EACC enquiring about the whereabouts of Justice Osero though they were yet to receive a response by the time of this publication.

"As the officials of the Kenya Magistrates and Judges Association, we have reports that our member, Hon. Corilus Osero Nyawiri is missing. 

"We have further information that the said Magistrate is being held by Officers of the Ethics and Anti-Corruption Commission (EACC)," the KMJA letter reads in part.

KMJA Secretary General Derrick Kuto revealed that on seeking a response from the EACC offices, they were informed that the commission had not arrested their colleague.

The EACC, however, indicated that they were aware of pending investigations against the missing magistrate and were advised to report the matter to the police.

The anxiety following the incident has been escalated by the fact that the Magistrate's mobile phone went off and has remained unreachable since then.
