3 Kenyans Still Hooked at ICC

The International Criminal Court is still hot on the heels of three Kenyans alleged to have interfered with witnesses who were to testify on the 2007/08 skirmishes at the Hague-based court. 

Journalist Walter Barasa, lawyer Paul Gacheru and Phillip Bett are currently facing prosecution after warrants of arrest were issued against them by the ICC.

According to the warrant of arrest against Barasa, he was criminally responsible as direct perpetrator for the crime of corruptly influencing or, alternatively, attempting to corruptly influence witnesses by offering to pay them to withdraw as ICC prosecution witnesses in the context of the Kenyan cases.

Owing to a request by Prosecutor Fatou Bensouda,  the Kenya Police arrested Gacheru and Bett in July last year and presented them before the High Court in accordance with the Kenyan law.

The ICC Prosecution team claimed that Gicheru influenced six witnesses in the case against Deputy President William Ruto and radio journalist Joshua Sang.

On the other hand, Bensouda stated that Bett contacted witnesses before taking them to lawyer Gicheru in a scheme that compromised witnesses against Ruto and Sang with money, who eventually withdrew from the case.

In a majority decision, judges on Tuesday stated that the Prosecution had failed to avail sufficient evidence against Ruto and Sang to sustain their crimes against humanity trial, hence terminated the case.
