3 Senior Magistrates Kicked Out of Courts

Three Magistrates were on Tuesday expelled from service on grounds that they were unsuitable to hold office.

The three Judicial officers were sent home over unexplained bank deposits, poor writing skills and issuance of harsh sentences.

Among the three was Bungoma Senior Principal Magistrate Teresia Njeri Ngugi, who was found culpable following inconsistencies in her bank records.

According to the Judges and Magistrates Vetting Board Chairman, Sharad Rao, Ms Ngugi's bank deposit records could not be explained.

“The board finds that the banking history does not match the record of activities. There are several large unexplained deposits in the Magistrate’s financial records,” said Mr Rao.

Tigania Chief Magistrate Bildad Ochieng’ was also axed after he declined to appear before the board for questioning on September 8, putting his integrity in question.

Eldoret Senior Principal Magistrate Lily Monica Nafula was also declared unfit to serve following complaints that she was harsh in the sentencing of a man who allegedly turned abrasive and abusive in court.

Ms Nafula is said to have ordered Mr Benjamin Juma Nyayiemi be locked up for 14 days. She conceded that the sentence was excessive but could not justify her decision which the board deemed to be harsh.

During the 16th meeting of the vetting team in assessing magistrates, the board's Chairman noted that some of the Judicial officers could not write properly.

“Writing skills continue to be a problem, and we continue to point out the gaps to the judicial officers,” said the board’s chairman Sharad Rao.

The three were among 26 vetted in the last two months by the Judges and Magistrates Vetting Board.
