Mathioya MP Arrested for Drunk Driving

Mathioya lawmaker Peter Kihara was arrested for drunk driving and spent Wednesday night at the Kilimani police cells.

The Member of Parliament was flagged down by police while 'recklessly' driving from Madaraka at around 8 pm.

According to reports, a chase ensued, which lead to his arrest on Mbagathi Way.

After police conducted an alcohol test it showed he had exceeded the allowable limits.

Nairobi DCI boss Ireri Kamwende noted that the MP will be taken to court on Thursday morning to face charges.

According to the constitution, any person who, when driving or attempting to drive, or when in charge of a motor vehicle on a road or other public place, is under the influence of drink or a drug to such an extent as to be incapable of having proper control of the vehicle, shall be guilty of an offence.

The law also maintains that the person is liable to a fine not exceeding Ksh100,000 or imprisonment for a term not exceeding two years or to both.

A person convicted of an offense under this section shall, without prejudice to the power of the court to order a longer period of disqualification, be disqualified, for a period of twelve months from the date of conviction, for holding or obtaining a license.

Last year, the National Transport and Safety Authority (NTSA) sought to implement a new form of punishment for drunk drivers where they could be sent to work in morgues in a bid to cut the country’s dismal road safety record.

Director General Francis Meja stated: “We cannot have notorious drunk drivers causing accidents yet when they appear in court the penalty is very lenient. Once we have the new policy ready then we shall ensure it becomes law.”
