Ezra Chiloba Takes Chebukati to Court Again

The Independent Electoral and Boundaries Commission (IEBC) CEO Ezra Chiloba has sued Wafula Chebukati for contempt of Court.

The estranged CEO now wants Chebukati to be put in jail for sending him on compulsory leave for the second time.

In the case filed on Friday, Chiloba identified the electoral body and Chebukati as the respondents.

He stated that the two disobeyed the High Court order revoking his suspension from the commission.

The court reinstated Chiloba after he was sent on a 3-month compulsory leave pending investigations of the 2017 General Election.

Justice Stephen Radido ruled that his suspension was unfair and reinstated him, hours late, Chiloba was served with another suspension letter from the commission.

After his reinstatement on Tuesday, Chiloba was locked out of his office and the keys kept away from him.

“I came back but I could not access my office. I cannot force my way inside but I will find a way to do that by seeking the intervention of the courts,” he stated on Wednesday.

The commission watered down the allegation that they had knowingly locked him out stating that it was a coincidence that Chebukati had left when Chiloba arrived.

The suit thickens the tussle between Chebukati and Chiloba with the former on the attacking side while the later is on the defensive.

In April, Chiloba filed a case alleging that he and his senior have had differences in different issues such as staff duties and the functioning of the commission.
