Miguna Miguna on Thursday jumped to Deputy Chief Justice Philomena Mwilu's defense over the corruption charges she is currently battling at the High Court.
Via his social media, the lawyer expressed his displeasure at the humiliation the DCJ had been subjected to in that she had been arraigned in a court lower than her position.
"Purporting to try the Deputy CJ Philemona Mwilu before a Chief Magistrate is like placing a Senior Private in charge of a court Marshall to try a 5-Star General.
"It is called insubordination and any decision from such a kangaroo tribunal is invalid," he tweeted on Thursday morning.
Director of Public Prosecutions Noordin Haji on Tuesday ordered her arrested and filed criminal charges against the DCJ.
On her part, Mwilu on Wednesday moved to the High Court in a bid to stop the Office of the Director of Prosecutions (ODPP) from prosecuting her.
She sued DPP Noordin Haji, along with DCI boss George Kinoti, Attorney General Paul Kihara and Anti-Corruption Court Chief Magistrate Lawrence Mugambi over what she termed as malicious prosecution intending to embarrass her.
Her application was accepted by Justice Chacha Mwita who suspended the criminal charges stating that the petition raised constitutional issues that need to be addressed adding that the charges Mwilu faced arose out of a commercial dispute.
He maintained that the court needed to determine whether a commercial dispute can amount to a criminal charge.
Chiming in on the legality of the charges, Political analyst Mutahi Ngunyi opined that Deputy Chief Justice (DCJ) Philomena Mwilu should face the military court.
"President Uhuru should evoke the 'Doctrine of Civil Necessity' and have Justice Mwilu court-martialed. Corruption is a state of war and the Judiciary continues their Civilian Coup. They should be stopped," he tweeted on Wednesday.
