Court Declines to Stop Matatu CBD Ban

The court on Monday declined to stop the ongoing ban on matatus from accessing Nairobi Central Business District (CBD)

Ruling on the mater filled by various matatu Saccos, the court directed the petitioners to serve the Nairobi County Government, NTSA and police with suit papers for hearing on Thursday.

21 matatu Saccos had gone to court in the morning, seeking to quash a decision barring their vehicles for entering the CBD.

They argued that the decision was made without taking into consideration that the operators had valid transport licences that allowed them to operate in the city centre.

Nairobi Senator Johnson Sakaja had also moved to court on Monday morning seeking to stop the ban citing the lack of public participation and availability of viable alternatives.

Speaking while appearing before the Senate County Public Investment Committee over issues raised by Auditor General in the audit for 2014/15 Financial Year, the governor apologised to Kenyans for any inconveniences that were caused by the traffic mess.

He further stated, “It is a matter of time and things will improve,” indicating on a light note, that the walk from the new termini to town would act as an exercise routine for city dwellers.

The ban, which started on Monday morning, required all matatus to operate from designated termini and were not allowed into the CBD to pick or drop off passengers.

More than 300 police officers were pooled to help county marshals enforce the ban which left thousands of residents walking from as far as City Stadium to Fig Tree in upper Ngara.

The ban is part of plans by the county government to address congestion in the CBD.
