Education CS Amina Bans Hiring of Retirees

Education Cabinet Secretary Amina Mohamed banned the hiring of retirees in public institutions under her ministry.

Issuing the directive, CS Amina ordered public universities, State corporations, boards and commissions under the Education Ministry to stop rehiring retired employees.

Reports have emerged that in the circular dated December 5, 2018, the CS noted that the practice had led to wastage of public resources.

Of great concern to CS Amina is that the retired chief executive officers (CEOs) and other top managers were receiving huge perks leading to wastage.

In a bid to tame the rogue dealings in her ministry, Amina directed the affected agencies to furnish her office with copies of the employment contracts and terms of service of senior staff who retired and later opted to continue working.

The CS raised concern on how ministry agencies and public universities had entered into employment contracts with CEOs, vice-chancellors and other top managers outside the legal framework.

"These contracts contain clauses that are irregular. Such clauses commit public resources by ensuring employees retain perks long after they have completed their terms.

"In some instances, this has resulted in post-contract litigation, leading to further waste of public resources in protracted legal battles," the CS added.

Amina cautioned institutions against flouting instructions issued by Head of Public Service Joseph Kinyua, who had provided clear guidance in a circular Ref. No. OP/SCAC/1/12(11) dated May 14, 2015 on the matter.

For instance, the CS noted how a retired vice-chancellor who had been retained in his institution but in a different capacity had been given a contract stipulating that he would earn a basic salary as paid in the last month of work, besides earning myriad perks in the new capacity.
