Director of Criminal Investigations (DCI) George Kinoti on Tuesday responded to the summons issued to four MPs over a leaked sex tape that Wajir Woman Representative Fatuma Gedi dismissed as fake.
Two MPs Aden Keynan (Eldas) Abdihakim Mohamed (Fafi), Women Representatives Rehema Jaldesa (Isiolo) and Purity Ngirici (Kirinyaga) had been accused of uttering defamatory statements that portrayed Gedi in bad light.
According to Standard, DCI Kinoti stated that the orders requiring the accused to appear for questioning have been dismissed.
He explained that there was no evidence to link them to the defamation claims.
“The orders were uncalled for and no need for the four to show up as initially ordered,” Kinoti was quoted by Nation.
Senior officials in Parliament had earlier snubbed the summons that had been addressed to the clerk of the National Assembly.
“Kindly inform them to report to the DCI headquarters, Kiambu Road at 10am to facilitate investigations,” the letter read.
However, Legal Counsel for the Directorate of Litigation and Compliance at Parliament, Josephat Kuyoni, advised the Clerk not to honour the DCI’s request.
Kuyoni stated that the summon is a threat to the immunity offered to lawmakers by the August House.
“Based on the foregoing case under investigation, it does not arise from the performance of duties of a Member of Parliament.
“As such, we recommend that the DCI corresponds directly with the said members,” Kuyoni advised.
