Court Orders KPC to Reinstate Sacked Whistle-Blower

The High Court has ordered Kenya Pipeline Company (KPC) to reinstate Maj (Rtd) Isaac Mati Ondari who was sacked for allegedly leaking information detailing procurement irregularities.

On March 14, Justice Hellen Wasilwa ruled that KPC’s decision to fire Ondari was unfair.

The judge stated that there was no evidence to prove that the former army man leaked any documents.

However, according to former KPC managing director Joe Sang, Ondari was sacked for leaking information to newspaper journalists.

Sang told the court that the leaked information was used to publish stories that made KPC look bad in the mainstream media and on social media.

He insisted that all lawful procedures were followed in sacking Ondari.

Despite refuting the allegations Ondari was sacked on November 11, 2016.

During his sacking, the security man was investigating a syndicate behind the theft of oil products from KPC’s Changamwe station.

The judgement is likely to breathe confidence into whistle-blowers.

This means that employers who reprimand staff for whistle-blowing must prove beyond any doubt that they leaked confidential information.



KPC has been riddled with mega corruption scandals that have seen billions of taxpayers’ money either stolen or misappropriated.



On March 14, it was reported that jet fuel worth Ksh3.4 billion went missing from KPC facilities.
