DCI Probes 2 Lawyers for Using Dead Farmers Documents to Defraud

Two lawyers are being probed by the Director of Criminal Investigations (DCI) for allegedly using fake documents of farmers whose contracts had been breached by Sony Sugar company.

Migori DCI director, Njiru Nyaga, on Tuesday, stated that the lawyers had been using fake documents of dead farmers to defraud the company.

This is after complaints were raised by families of the deceased farmers.

Nyaga pointed out that some of the farmers involved in the matter had died several years ago yet they had filed the cases and sworn affidavits years after their death.

It is alleged that in one case, a dead farmer had two cases in the same court demanding to be paid because his cane had not been harvested.

In yet another matter, relatives of a farmer who died in 2013 were also mesmerized to find out that their father had filed a suit in 2017.

However, his son sued the law firm, accusing the lawyers of fraud.

In a past interview, Sony Sugar Managing Director Bernard Otieno stated that there was a team working to inspect the suspicious cases.

“After doing due diligence and talking to our farmers, about 1,000 cases have been terminated when we established the farmers were not even aware they have been filed," Otieno stated.

Investigators revealed that the fraudsters, whose names cannot be mentioned due to the investigation purposes, have been changing contracts of the unsuspecting farmers to file cases in Rongo, Migori, Homa Bay, Kisii, and Kehancha towns. 

The DCI director also noted that other lawyers were also being probed in the fraud case.
