Lawyers' Spirited Fight Spares Assa Nyakundi Murder Charge

City Lawyer Assa Nyakundi was, on Thursday, spared the murder charge despite his admission that he accidentally shot dead his son.

According to Daily Nation, the embattled lawyer owes his success to his lawyers who fought tooth and nail to ensure that the only charge he has to face is manslaughter.

The Director of Public Prosecutions (DPP) Noordin Haji had filed a suit seeking to have the lawyer charged with murder for allegedly shooting his son.

His lawyers, on the other hand, opposed the move arguing that the charge could not proceed given that the lawyer was still facing a manslaughter charge related to the matter.

The team, consisting of lawyers John Khaminwa, Haron Ndubi and Danstan Omari among others, also claimed that the DPP had not decided which case he wanted to pursue and that the two could not run concurrently.

“We opposed the withdrawal of the manslaughter case and the applications have been argued by all parties and it is pending for ruling,” they argued.

On his part, Haji, as reported by Capital FM, sought to have the manslaughter charge reviewed explaining that the investigations were bungled and some of the detectives had been compromised.

Justice James Wakiaga, therefore, directed the complainant and the defendants to appear in court on Friday where he will issue further directions about the case.

Nyakundi was also released on bond terms that had been directed by a Kiambu magistrate.

The accused has previously claimed that the fatal shooting occurred accidentally as he reached out his pistol from the back seat of his car while driving home from church in March.
