Uhuru Orders Reinstatement of Supreme Court Judge

President Uhuru Kenyatta, on Thursday, ordered the reinstatement of a supreme court judge who had been suspended.

Uhuru gazetted the reinstatement of Justice Jacktone Ojwang, following the ten-day allowable timeline for any appeal against the decision of the Tribunal.

According to Uhuru, the decision to reinstate Ojwang was made since there had been no appeal against the decision of the tribunal.

"In accordance with the recommendations of the Tribunal, the suspension of Hon. Mr. Justice (Prof.) Jackton B. Ojwang, Judge of the Supreme Court of Kenya is lifted and that Ojwang is therefore reinstated to Office, and all remunerations and benefits adjusted during the term of his suspension," Uhuru announced.

Previously, the Supreme Court judge was under probe over gross misconduct, for allegedly delivering a favourable ruling to Migori Governor, Okoth Obado, in exchange for commissioning of roadworks to his residence.

Earlier in March, Chief Justice, David Maraga, wrote to the President, recommending the formation of a tribunal, to determine whether Justice Ojwang' would be expelled from the Supreme Court. 

In a special gazette notice, the President appointed Justice Alnasir Visram to chair the aforementioned tribunal. 

The Head of State explained that the move followed allegations contained in the petition by the Judicial Service Commission (JSC) of Kenya as filed by Nelson Oduor Onyango and eight others which were presented to him regarding the conduct of the judge.

However, a team led by appeal judge Alnashir Visram, which investigated his conduct, absolved him of any wrongdoing after analyzing evidence from more than 15 witnesses.

The justice Visram-led tribunal handed its findings to Uhuru and recommended that he lifts the suspension imposed on Ojwang.

The team also recommended that the judge resumes work with immediate effect.
