Sen Linturi's Father Dies, Battle Ensues

Marianne Kitany has sought to adjourn the divorce case that she is embroiled in following the death of the father to Senator Mithika Linturi on Monday.

Kitany, through her lawyer Danstan Omari asked a Nairobi Magistrate to adjourn an ongoing cross examination until Friday to grant her time to mourn the abrupt demise of her father-in-law.

“On behalf of the petitioner, we are not ready to proceed. She lost her father in-law, who passed on last night. She is mourning and in the process of going to Meru to be part and parcel of the burial programme,” Mr Omari is quoted.

“She cannot proceed with this matter. I have very strong instructions from her to pass her sincere condolences to her husband and the entire Igembe people.”

Mithika Linturi has however read malice in the application and rejected the adjournment plea, saying that he was determined to carry on with the case and the death of his father should not be used as an excuse to deny the case.

Through His lawyers Prof Wajackoya, speaking for Linturi told the court that his father was unhappy because of the scandalous allegations from Kitany who stated that she built him a house.

The resident magistrate said that it was not in his place to determine if Kitany was Linturi's senior daughter in law or whether they were infavorable terms.

The divorce case between Linturi and Kitany has attracted considerable attention in the media.

The petition was filed by Kitany at the Meru Law courts in August but she later requested for the case to be transferred to Nairobi.

Less than two months ago, Kitany through her lawyer, Danstan Omari, asked the court to order the police to investigate the legislator for alleged bigamy (marrying someone while already married to someone else) as well as forgery.

The court was adjourned to Wednesday since Ms Kitany was not in court.
