Police IG Hillary Mutyambai Faces Jail Term

Inspector General of police Hillary Mutyambai could face a civil jail term if the case filed by Braeburn School succeeds.

This prospect arose from a case filed by Education Investment Company, which owns several prestigious learning institutions and is battling to retain ownership of a 50.6-acre tract in Nanyuki.

The government has been attempting to recover the land on the grounds that it belongs to the public.

Ministry of Industry, Trade and Cooperatives intends to establish a textile factory in the land that it claims was transferred to the school fraudulently.

Braeburn school director Robert Williams maintained that the school was the registered owner of the land having purchased it in 2009 for Sh40 million.

Williams wants IG Mutyambai and Laikipia County Commissioner, Daniel Nyameti, charged with contempt of court having defied and disobeyed orders issued on Tuesday, August 8, by Environment and Land Court Judge Mary Oundo.

The orders restrained the government from interfering with the suit property in any way pending hearing of the dispute.

In the suit, Williams stated that the police have denied the company and its tenants' unconditional access to the property as ordered by the judge.

Civil imprisonment concerns an offense that is not of criminal nature..
