Family Compels Judge to Free Father Despite Killing His Son

An elderly man from Nyeri County was freed following his family's pleas, despite killing his own son.

A report by Daily Nation indicated that members of Francis Mwangi Karebe's family had revealed that they were in good terms with him, in contents that were provided to the court by a pre-bail report.

Karebe was accused of murdering his own son, Simon Macharia, on Sunday, October 13, usings arrows while at their home in Peter Ciira Village, Mathira East Sub-county.

Probation Officer Faith Nzivulu revealed in her pre-bail report that Macharia, who had a long-standing squabble with his father, was an alcoholic and on the fateful day, he attacked Karebe who killed him in self defence. 

“The victim had separated with his wife and it was not the first time they had an altercation but it was never suspected it would take the ugly turn. The accused lost his wife five months ago.

“Karebe is aged and ailing, he has blood pressure and is currently on medication. He is not a flight risk,” read the pre-bail report in part.

Family members told the court they were worried about the 88-year-old him being detained the police remand.

“They are willing to accept him back, his absence is causing them sleepless nights,” continued Nzivulu.

The prosecution did not oppose the release terms, with the state counsel arguing that as it stood, Karebe did not pose as a flight risk.

“The accused is hereby advised to observe timeliness on both hearing and mention dates of the case. He should not interfere with witnesses and must be of good conduct during the bond period. On breach of the terms, the bond will be cancelled,” ruled Justice Abigail Mshilla

Karebe was subsequently released on Ksh500,000 bond and the case is set for trial on February 10, 2019.
