WhatsApp Group Earns a Man 3-year Jail Sentence

Kisumu Senior Resident Magistrate Stella Telewa sentenced a 24- year-old Abdala Mustafa to three years in prison for being in possession of terrorism-related material on Tuesday, November 26.

Nation reported that during the hearing, witnesses told the court that the accused was found with 9 terrorism-related videos.

He pleaded guilty and asked the court for forgiveness, which was not forthcoming.

He confessed to receiving the videos from a Whatsapp group that disseminated the terrorism-related content but denied knowing it was against the law.

In her ruling, the judge noted that although he was not in any of the videos, he was also found with terrorism-related articles.

“It is evident that the videos were downloaded. What is not clear is why the accused downloaded them if he did not need them,” the Judge said.

The jurist also faulted the suspect for not reporting the activities of the group to the police. 

Mustafa was first arrested on June 18, 2018, in Kisumu, after which he was charged before Magistrate Rose Ndumbi.

He denied the charges and was released on a Ksh50,000 cash bail or Ksh300,000 bond.
