Mzee Moi Repossesses 2,700-Acre Land after 13-Year Battle

A trust associated with former President Daniel Moi has won a 13-year court battle over a parcel of land measuring 2,700 acres.

According to a report by the People Daily, Rift Valley Development Trust moved to court arguing that the companies that occupied the land, which include Rift Valley Institute of Science and Technology (RVIST), subdivided the parcel illegally and sold it off.

The trust was, therefore, seeking to have the land restored to the expansive 5,000-acre Deloraine Farm in Salgaa and 3,000-acre Technology Farm located outside Nakuru.

In his ruling on Wednesday, December 4, Justice Sila Munyao concluded that there was no evidence that the trustees had made approval of the purchase of any section of the land.

He further stated that the blocks which claimed to have originated from the land did not do so lawfully and declared their ownership null and void.

The firms were subsequently directed to revert disputed portions to the trust within 30 days.

“The court hereby proceeds to nullify all subdivisions of the said land and therefore order that it be reverted to the second plaintiff. From the foregoing, it will be discerned that my finding is that the Trust deserves to hold the title of the whole land and therefore cancels all titles on the said land.

"The defendants in the suit are to surrender the land and give possession within 30 days from this ruling date,” ruled Munyao.

Shortly after the ruling was made, the trust's secretary Julius Sunkuli celebrated stating that the journey had been long but they won at last.

“We are happy with the judgment; it has been a long journey for us as a trust, we were against any subdivisions of the land and now we can get back to utilise the same accordingly to the benefit of the shareholders,” celebrated Sunkuli.
