Obado Kicks Out Sharon's Family Lawyer From Murder Case

Migori Governor Okoth Obado scored a major win in the case he and two others are facing over the death of Sharon Otieno

In a ruling made on Wednesday, December 18, Lady Justice Ngenye Macharia barred the lawyer representing Sharon's family from getting involved in the case.

According to KBC Ngenye barred Professor George Wajackoyah, noting that he had confidential information from Governor Obado which he could use against him in the trial.

Additionally, she noted that the victim's family was at liberty to engage any other lawyers, apart from Wajackoyah.

Obado, through his lawyers Kioko Kilukumi and Roger Sagana, had argued that three days after his arrest Wajackoyah had visited him at Gigiri Police Station, where they discussed the case.

Kilukumi told Lady Justice Ngenye that the family lawyer had told Obado that he could represent him because he had done consultancy work with the ODPP and the DCI.

“Wajackoyah showed me correspondence between himself and the two offices, and I was convinced that indeed he had good knowledge of criminal law practice. He further confirmed that the two offices nevertheless cleared him to represent me,” Obado had argued. 

The governor revealed that he gave Wajackoyah the green light to join his legal team and gave him the details of the case.

Wajackoyah is said to have shifted camps after his name was eliminated from the list of Obado's representatives during his arraignment on September 24, 2018.

“The advocate took serious issue with the omission of his name from the quorum and informed me as much. In the subsequent court appearance, he came to court and introduced himself as the advocate for the victims. He continues to be on record for the victims to date,” Obado's affidavit read.

In his argument, Wajackoyah through his lawyer, Duncan Okatch, claimed that Obado wanted to deny Sharon's family fair representation.
