UPDATE Wednesday, June 10: Senate Speaker Kenneth Lusaka confirmed receiving Kirinyaga Governor Anne Waiguru's impeachment resolution.
"Yes we have received a copy of the proceedings, we have now handed it over to the legal team to start looking at what has been brought just in preparation for persecution," he noted.
UPDATE Wednesday, June 10: Kirinyaga County Assembly Speaker, Anthony Gathumbi issued an impeachment motion of Governor Anne Waiguru to Senate Speaker Kenneth Lusaka.
"I write to inform you that in it's sitting held on the morning of Tuesday 9 June 2020, the County Assembly of Kirinyaga in a motion supported by 23 members constituting over two-thirds of all members of the County Assembly, resolved to remove Hon. Anne Mumbi Waiguru from the office of the County Governor of Kirinyaga," read the letter in part.
Confusion marred the receiving of Kirinyaga Governor Anne Waiguru's impeachment motion after Gatundu MP Moses Kuria and Senate Speaker Ken Lusaka posted conflicting messages.
Moses Kuria took to Facebook on Tuesday, June 9 to reveal that Lusaka had appointed a committee to handle the impeachment of Waiguru.
"Speaker Ken Lusaka appoints 9 person committee to consider the impeachment motion against Governor Anne Waiguru," wrote the MP.
Kuria went on to post the names of the committee members that will allegedly be chaired by Baringo Senator Gideon Moi who will be deputised by Siaya Senator James Orengo.
Senate Majority Whip Irungu Kang'ata was part of the team according to Moses Kuria alongside Fatuma Dulo, Johnson Sakaja, Ephraim Maina, Mutula Kilonzo Jr, Cleophas Malala and Ledama Ole Kina.
Lusaka, however, quashed Moses Kuria's claims as he cleared the air stating that he is yet to receive Waiguru's impeachment motion.
"I have not yet received any notification from the Kirinyaga County Assembly Speaker regarding the impeachment of Governor Anne Waiguru.
"My office will act accordingly once we receive the communication and documents in evidence of the Assembly proceedings today (June 9, 2020)," noted Lusaka.
Makueni Senator Mutula Kilonzo Junior raised questions on whether the county assembly ignored a court order obtained by Waiguru.
"The question whether the County Assembly of Kirinyaga acted in contempt of the High Court order by proceeding to impeach Governor Anne Waiguru raises serious fundamental questions of law. We await the proceedings!" he explained.
After the impeachment of a governor by the county assembly, the speaker of the Senate convenes a meeting of the Senate. The meeting is to hear the charges the county assembly brought against the governor.
The Senate, by a determination, then appoints a special committee comprising of eleven of its members to investigate the matter.
The Senate meeting and the appointment of the special committee should occur within seven days from when the Senate speaker received the notice from the county assembly speaker.
The committee should report to the Senate within ten days after investigation of the matter. It should report whether it finds proof for the charges the accuser brought against the governor.
If it finds proof, the Senate proceeds to vote on impeachment charges while no proceeding will take place if there is lack of proof.
If a majority of the senators vote to uphold the impeachment charge, the governor ceases to hold office while if the senators vote against the impeachment charge, the Senate speaker should notify the speaker of the respective county assembly.
Any member of the county assembly can only introduce the same charges before the assembly after three months from the day the Senate votes against the impeachment charges.
