Exiled constitutional lawyer Miguna Miguna on Saturday, December 19, expressed his interest in vying for the Nairobi Gubernatorial seat following the ouster of Mike Mbuvi Sonko.
In a statement, Miguna indicated that he had consulted constitutional lawyers on whether he stood a chance to vie for office while outside the country.
"Given the president's refusal to allow me entry to Kenya in violation of many court orders, doesn't the Constitution grant me the right to vie for public office from exile?" he posed to the lawyers.
Miguna indicated that he had received legal advice from constitutional lawyer Waikwa Wanyoike saying that it was possible for him to vie.
"I, Miguna Miguna, a Kenyan citizen by birth and registered voter in Nairobi, hereby declare my candidature for the position of Governor of Nairobi in the upcoming by-election," he declared.
The gubernatorial seat fell vacant on Thursday, December 17, after senate voted out Sonko on grounds of gross violation of the Constitution, abuse of office, gross misconduct and crimes under national law.
Miguna and President Uhuru Kenyatta have had a rocky relationship since the former tried to swear in ODM leader Raila Odinga as the People's President on January 18, 2020.
In January 2020, the barrister unsuccessfully tried to return back to the country to attend his father-in-law's burial.
This is after he disclosed that President Uhuru Kenyatta had issued illegal 'red alerts' and threatened to withdraw landing rights to all airlines that flew him back.
"Having waited for Uhuru Kenyatta and his appointees at the Ministry of Interior to obey court orders and revoke their illegal 'red alerts' to no avail, I've no option but to return to exile in Canada. I'll not surrender. The struggle continues," Miguna stated at the time.
The government would respond to Miguna's allegations saying that he was categorized as an unruly passenger on March 18, 2018, in line with Annex 17 of the International Civil Authority Organisation standards.
