CJ Koome, MPs Clash Over Courts' Roles

A clash has ensued between the judiciary and the legislature over the latter's oversight of the courts and the Judicial Service Commission.

This comes after Chief Justice Martha Koome blocked Chief Registrar Anne Amadi from appearing before the Public Accounts Committee to respond to audit queries.

Ms. Amadi, the  Judiciary's chief accounting officer was summoned by the PAC to explain irregular staffing policies.

According to parliament, at least 10 judicial officers have been acting for more than ten years with no indication on when they will be confirmed.

This was flagged off by Auditor General Nancy Gathungu as a violation of the Judiciary's Human Resources Policies and Procedures Manual in her 2018/2019 audit report.

One of the staff, Ms. Susan Oyatsi, has been serving as an acting director of finance for at least ten years.

On July 7, CJ Martha Koome wrote to Speakers Justin Muturi and Ken Lusaka protesting the summoning of the chief registrar.

In her letter, the Chief Justice proposed for a consultative meeting between herself and the speakers of the two houses of parliament.

"This tendency by parliament in the exercise of its oversite mandate is worrying and urgently needs to be addressed," read the letter by the Head of the Judiciary.

She further stated that the Members of Parliament's input threatens the normal functioning of the Judiciary and JSC.

The Judiciary had been at loggerheads with yet another arm of government, the executive, over the appointment of 6 judges to the Court of Appeal.

The six were left out by President Uhuru Kenyatta who explained that his decision was guided by intel he received on the six judges.
