Supreme Court Stops Kananu Swearing-In

The Supreme Court on Monday, October 25, stopped the swearing in of Anne Kananu as the Governor of Nairobi City County.

This comes after former Nairobi Governor, Mike Sonko, filed an appeal challenging a decision that had paved way for Kananu to take over.

In this this regard, the swearing in of Kananu, which was set for Tuesday, October 26, was put on hold for two weeks to allow the court issue further directions.

Sonko's urgent application and affidavit were received by Justice Ibrahim Mohammed, who issued a conservatory order stopping any swearing in within the next 14 days.

"I hereby grant prayers 1 and 2 of the Motion for a limited period of 14 days pending inter parties hearing of the said motion and in terms of Section 24 of the Supreme Court Act, 2017," the statement read in part.

On October 22, the Court of Appeal threw out Sonko's petition to challenge the swearing of Kananu as governor. In its ruling, the court declared that Kananu should be sworn into office.

The Appellant Court declared that ousted governor's application did not meet the threshold set for such applications under the rules of the Court of Appeal.

Sonko had asked the court to issue orders barring Kananu from taking the oath of office pending the hearing and determination of the intended appeal.

Initially, the court had sided with the petitioner, issuing a conservatory order restraining anybody or any state organ or authority from swearing-in Kananu into office pending the hearing and determination of the intended appeal. 

Attorney General, Kihara Kariuki, urged the court not to block the deputy Governor's vetting, arguing that her predecessor has no powers to revoke her nomination.
