Meru Senator Mithika Linturi is now demanding money he allegedly sent to a woman who has sued him accusing him of attempted rape.

Appearing at the Milimani Law Courts on Tuesday, November 9, for a pre-trial session of the attempted rape case, Linturi, through his lawyer Muthomi Thiankolu, insisted he wants back the money he sent to the complainant in the case.

Linturi allegedly offered the woman in question Kshs 200,000 and a Kshs 800,000 cheque in a bid to settle the matter amicably.

He now argues that the woman and her husband were extorting money from him following the incident that took place on January 30 this year at Maiyan Villas in Nanyuki.

Linturi's lawyer asked the court to order the prosecution to release the money recovered from the complainant and hand it back to the Legislator with immediate effect.

"Your honour, I am making an application to have prosecution release Ksh200,000 which is in their possession for the last 1 year. The said money belongs to my client and was recovered from the complainant by the police,” Muthomi stated.

However, the state prosecutor, Alice Mathangani, told Justice Susan Shitubi that the Ksh200,000 in question is an exhibit that will be used in court as evidence and thus cannot be released.

The lawmaker also appealed to the Director of Public Prosecutions (DPP), Noordin Haji, to expedite his case and produce the evidence against him, calling on his accuser to come forward and face him in court.

“I want to appeal to the Director of Public Prosecutions to supply the evidence in this matter. I don’t want any more adjournment by the state. I want to see the lady I’m accused of attempting to rape,” Linturi stated.

Linturi also asked the court to order the state to supply him with the witness statements of the complainant and the OB number, claiming that he had not received the two documents.

However, the state prosecutor told the court that the investigating officer requires time to confirm whether the said documents are in his possession and supply them to the defence team.

He went on to urge the media to provide enough coverage of the case and asked the DPP to expedite his case so as to allow him enough time to clear his name ahead of the 2022 elections.

In August 2021, the Meru Senator moved to the High Court in an attempt to block his arrest and prosecution over the matter. High Court Judge, Weldon Korir, declined to grant Linturi conservatory orders.
