Judge Intervenes After Witness Faints While Testifying Against Ex-Lover

High Court Judge Patrick Otieno adjourned court proceedings after a woman fainted while testifying against her ex-husband, who was accused of killing her father in cold blood.

Justice Otieno agreed with the prosecution that the witness was not mentally fit to face the Kakamega court.

The witness who took to the dock on Friday, October 28, lost consciousness while recounting how her father was brutally attacked in their own home.

"She's traumatised and overwhelmed by emotions and is rightly not in a proper state to testify in the matter today.

"We've tried to calm her down to no avail and pray that we get another date for the case to allow her time to heal," the prosecution pleaded.

The judge adjourned the case for two months to December 21 to allow the witness ample time to prepare herself psychologically. 

Before being overwhelmed with emotion, she told the court that the suspect had severally made unwarranted visits to their home after their separation.

"He made it a habit to pass by to verbally abuse me. On the day in question, my father requested to know why he lacked respect for my family and me,” she told the court.

The inquiry by the witness's father angered the suspect, who allegedly insulted the deceased before following him to his farm, where he attacked him viciously. 

"He kicked him in the stomach before picking a huge stick from the ground and landing a blow on the back of his head,” she recalled painfully. 

An attempt to save her father put her life at risk as her ex-lover turned his wrath on her. The suspect reportedly scampered for safety after neighbours intervened.

Her father was rushed to the hospital, where he was pronounced dead on arrival. The victim's troubles were later on compounded by the death of her mother, who succumbed to high blood pressure in March 2022.
