Law Society of Kenya (LSK) president Eric Theuri has revealed that Brian Mwenda, the university student accused of impersonating a lawyer, is at the Directorate of Criminal Investigation Offices.

According to the LSK boss, the DCI have gathered substantial evidence against the impostor even as they continue with investigations.

“Brian Mwenda Njagi is now at DCI. We are going to ensure that he faces the full force of the Law. The evidence gathered so far points to several cases of forgery & identity theft," Theuri wrote.

"Further inquiries are ongoing. We are working closely with the DCI team to conduct thorough & extensive investigations. This case will be a deterrent for future masqueraders.”

Mwenda had been practising the law without a license even representing ex-Mungiki leader, Maina Njenga, in televised court proceedings.

Theuri disclosed the details of the fake lawyer's plot when he presented the case to the DCI.

According to the LSK president, Mwenda had taken up the name of a real advocate also named Brian Mwenda and had been posing as him.

The real Mwenda discovered something was amiss when he tried to apply for a law practising certificate but could not access his account on the LSK portal.

A probe into the issue revealed the fake lawyer's impersonation strategy.

The impostor, had taken over advocate Mwenda's account, changed his login details, profile picture and workplace before proceeding to apply and pay for a practising certificate.

However, LSK says that the fake lawyer was not able to complete the application process because he was required to present extra documents that he did not have.

"The LSK has commissioned an immediate review of the established protocols on change of membership credentials to enhance the internal approval mechanisms," Theuri said at the time.

Meanwhile, Mwenda's father, Arnold Njagi, has come out to defend him saying he is a qualified lawyer, having pursued a diploma course in criminology in 2016.

"He pursued a diploma course in criminology which enabled him to join Strathmore University in 2017 and graduate in 2020.  In 2021, he joined the Kenya School of Law and completed in December 2022," Njagi revealed.

"His first case was representing a family member in court. He made an application for appeal but unfortunately, there was no response to his application. So, he has been working in Nairobi until recently when he told me that some people were claiming that he is not a qualified lawyer," he added.
