Brian Mwenda Granted Ksh200K Bail

Alleged fake lawyer Brian Mwenda, who is on the hook for impersonating another advocate was on Monday granted a Ksh200,000 cash bail.

Mwenda had earlier filed an affidavit requesting a Nairobi court to release him on bail or bond.

In the suit filed by his lawyer, Danstan Omari, Mwenda denied all the accusations leveled against him as baseless and dismissed the arguments that he evaded being arrested by the Directorate of Criminal Investigations (DCI) detectives and that he is a flight risk.

"Statements that I am a flight risk are merely speculative and now that I understand that I am under investigations, there is no reason for me to get out of the court's jurisdiction nor abscond attending court but this can be taken care of by the court imposing an order for me not to leave the courts jurisdiction during the pendency of this suit unless otherwise permitted by this court," Mwenda said in his affidavit.

Mwenda also faulted the Law Society of Kenya (LSK's), heavy involvement in the case saying that the mandate to investigate and prosecute cases solely lies with the National Police Service (NPS) and the Office of the Director of Public Prosecutions (ODPP).

However, a standout development in the case was Mwenda's revelation that Law Society of Kenya (LSK) President Eric Theuri who has been vocal in dismissing Mwenda as a quack claimed that Theuri, on numerous occasions in the past, used his powers to bail out Mwenda and his friends from different police stations whenever they were arrested for drinking.

As such, Mwenda wants Theuri, and Vice President Faith Odhiambo barred from representing the Society on account of his close relationship with them.

"In the unlikely event that I am put on defence, I may be calling both of them in this case as my defense witnesses," Mwenda said.

Mwenda claimed that Theuri and Odhiambo have immersed themselves in the case to prevent him from revealing sensitive information about them, having known them for a period of 2 years.

The alleged fake lawyer further claimed he played a huge role in campaigning for Theuri when he sought the LSK presidency in 2022.

Mwenda was arrested on October 17 after presenting himself at the DCI headquarters.

The arrest came after LSK flagged him for impersonating another advocate and practicing without a license.

At the time, speculation was rife that he had argued 26 cases and won all of them but LSK has since dismissed that claim.
