American Woman Sues AG Githu Muigai and CS Nkaissery

An American woman has taken Attorney-General Githu Muigai and Interior Cabinet Secretary Joseph Nkaissery to court over the validity of her work permit.

Jean Eleanor Margaritis Otto filed a suit at the High Court seeking to stop her prosecution following the expiry of her business visa.

The aid agency worker, says immigration officers arrested and detained her on July 3, and threatened to deport her if she did not bribe them to validate her stay in Kenya.

Ms Otto said that despite showing the officers her passport and six-month business visa, they insisted that a handwritten '1m' on her passport means she was only granted a month’s stay in Kenya, Business Daily reports.

Otto now says her prosecution after her visa was annulled could lead to her unlawful deportation.

Prof Muigai, Nkaissery, the Milimani Chief Magistrate’s Court and the Director of Immigration Services have all been enjoined as respondents in the suit.

Through her lawyer, Otto said that her travel documents were confiscated at the immigration offices adding that she was hurriedly arraigned in court after she refused to bribe the officers.

She complained that there were alot of irregularities in her arrest and charging hence she wants the hearing of her case halted until her application to throw out the charges is heard and determined.
