Court Suspends 2017 Ballot Paper Tender

The High Court on Monday suspended the award of a tender for supply of ballot papers to a Dubai company following an application filed by the CORD Coalition.

Justice George Odunga suspended the Sh2.5 Billion tender that also affects the delivery of declaration forms and poll registers until the case filed by the Opposition is heard and determined.

While giving the ruling, Odunga directed that the order be printed on national newspapers noting that the matter was of great public interest.

CORD moved to court after the IEBC awarded the tender for the supply of 130 million ballot papers for the 2017 election to Al Ghurair Printing and Publishing Company.

Through lawyer James Orengo, the Coalition sought for the suspension on the basis that the tender award contravened the Election laws and Public Procurement & Assets Disposal Act.

At the same time, CORD included the firms in question, Parl Media Limited and Al Ghurair Printing and Publishing Company in the case which will now be heard on December 21.

The Coalition has been opposing the tendering process and auditing of the voter register accusing the electoral Commission of having planning to rig the upcoming polls.

It has on numerous occasions maintained that the body does not have the mandate to transact with the already-resigned commissioners still in office.
