Dennis Itumbi to Wait Longer in Sh50 Million Case Against State

State House Director of Digital Media Dennis Itumbi will have to wait longer in a case where he has sued the government for unlawful arrest and detention.

Itumbi was subjected to a dramatic arrest on March 22, 2012, and later detained for four days after he was suspected to have leaked crucial information relating to the International Criminal Court (ICC).

After the arrest and detention, the then blogger-cum-activist was released without any charges being preferred against him.

The now Senior State House official would later file a case against the State with Attorney General Githu Muigai, Director of Public Prosecution Keriako Tobiko, and Inspector General of Police as the parties in the suit.

Itumbi sought to persuade the court that he should be provided with compensation amounting to Sh50 Million for the alleged breach of his rights.

The DPP, however, opposed the plea made by the petitioner stating that Itumbi’s arrest was not illegal since failure to prosecute him was informed by the lack of evidence to prove the allegations made against him.

On Tuesday, High Court Judge Joseph Onguto promised to deliver the judgement on February 7.

Incidentally, the postponement of the case comes a few days after Itumbi made a plea to Chief Justice Maraga, asking for the judiciary to be more expeditious in the delivery of Justice.
