High Court Roselyn Aburili Suspends Law on Campaign Financing

The High Court has suspended implementation of a rule that could bar CORD leader Raila Odinga from contesting for Presidency in the upcoming General Election.

On Thursday, Justice Roselyn Aburili blocked the implementation of the law requiring political aspirants to submit their campaign finance and management information to the IEBC until January 12, when a case challenging the rule will be heard.

The ODM Party had moved to court after the electoral body indicated that Odinga had failed to comply with the campaign financing regulations act that required all aspirants to open and file campaign accounts with the IEBC before the December 8 deadline.

The Judge noted that "the case by ODM through its lawyer Anthony Oluoch raises serious Constitutional issues which need to be disposed of urgently."

IEBC Chief Executive, Ezra Chiloba had in December stated that the secretariat would decide whether the former Prime Minister and other candidates who had failed to comply would contest in the August polls.

In its case, ODM argues that the law is "unenforceable and unreasonable given that it only gave political parties a matter of hours to comply with a requirement that came into being in 2013".

On why he declined to comply with the rules, Odinga said the Isaac Hassan-led team's time in office had expired after resigning in October and that he didn't recognise the commissioners.

The former Prime Minster also argued that the laws were defective and that they had not even conducted nominations to decide on the candidates to run for various seats.
