Joho's Gun Certificate Reinstated

Interior Cabinet Secretary Joseph Nkaissery was on Friday directed to stop harassing Mombasa governor Ali Hassan Joho or any of his aides.

The order was issued by High Court judge George Odunga in a case in which the governor had sued the State following the withdrawal of his firearm certificate.

Judge Odunga further directed that Joho's licence be reinstated arguing that the withdrawal was unprocedural and unlawful.

“Those misusing firearms are obviously abusing the certificates hence the government should not hesitate to withdraw their licenses. In this case, the decision to withdraw the applicant's certificate is hereby quashed,” Odunga directed.

Through lawyers Antony Oluoch and James Orengo, the ODM deputy leader criticised the manner in which the matter had been handled, stating that he was ordered to surrender his guns and certificate or face arrest without any explanation of his wrong doings.

Joho's licence was revoked in March and his bodyguards withdrawn just days after chaos erupted during Malindi by-election.

The move sparked condemnation from leaders who described it as intimidation for his staunch association with the Opposition, since it was done without any formal communication.

The governor, later moved to court suing the CS, the Inspector General of Police, the Chief Firearms Licensing Officer and the Attorney General.
