Almost eight years later, a former Kenya Army recruit who was kicked out of training college on the graduation day has received consolation.
This is after the Employment and Labour Relations court in Nairobi ruled that the recruit identified as Nasibo Dabaso Jilo be paid 3 million shillings as compensation for the pain and suffeing caused by the action.
Court Justice Mathew Nduma Nderi ordered Kenya Army commander Lieutenant-General Leonard Ngondi to pay Sh3 million to the young woman who was kicked out on the day of the pass-out parade, the Nation reports.
The young woman from Moyale is said to have been sent away in 2007 on allegations that she was asthmatic.
Ms Njilo was kicked out without prior notice or even any medical report to verify allegations that she was asthmatic, the judge noted.
Judge Nduma awarded her damages, saying the action wasted her future and “condemned her to a life of deprivation and poverty”.
The Judge further said “the manner in which the discharge was done on the day of pass-out parade, while her family had arrived for the event was both degrading, inhumane and grossly violated her rights.
The court also ordered the Attorney General Githu Muigai to ensure Ms Jillo's national identity card is delivered to her by the Moyale District commissioner within 30 days.
The woman had sought to be paid Sh69 million for the violation of her rights, fundamental freedoms and terminal dues until her retirement age at 60.
