CJ David Maraga to Meet President Uhuru After China Visit

President Uhuru Kenyatta is set to meet Chief Justice David Maraga to discuss the negative relations between the Judiciary, Legislature and the Executive arm of the government.

The meeting that was scheduled for Thursday is uncertain as the date of the president’s return to the country from China is yet to be confirmed.

The agenda of the meeting will revolve around Judge Mohammed Warsame’s failed swearing into the Judicial Service Commission and the reduced funding for the Judiciary.

According to Tom Ojienda who is a member of JSC, the parliamentary committee members agreed to push for the reinstatement of the funds lowered from the Judiciary’s allocation for this financial year.

Ojienda’s remarks come days after a joint retreat by JSC members and Parliament’s Justice and Legal Affairs Committee in Mombasa.

Judiciary’s spending was lowered by Sh2.8 billion with Sh50 million allocated for development, an action that Maraga bitterly complained about.

“I think the talks were fairly positive and there have been engagements. We justified to them why we need the Sh1.8 billion to deal with pending court projects. The committee agreed to push the agenda to Parliament. There is also engagement with the Executive, but we are looking forward to a more formal approach,” stated Ojienda.

The Law Society on Kenya on Wednesday took CJ Maraga to court over failure to swear in Judge Warsame as a member of the JSC.

The law body blamed the president for the failed swearing in of the judge and termed it as a violation of the constitution and neglect of duty.

LSK, through the petition, demanded that Warsame is not subject to vetting by the National Assembly having been elected by the Court of Appeal.

The law body further asked for an invalidation of the claimed nomination.

In March, the High Court prevented Parliament from vetting Warsame after the president forwarded his name following a petition by the law body.
