Alfred Mutua Issues Demands to Boniface Mwangi Over House Bombing

The Governor of Machakos, Alfred Mutua, is now demanding an apology from activist Boniface Mwangi who has linked him to the destruction of his house in Athi River, Machakos County.

Through his lawyers, Governor Mutua in a letter dated Thursday, October 21, termed a video published by Mwangi as libelous, defamatory, and aimed at soiling his otherwise good reputation.

Earlier in the day, the activist insinuated that the governor was responsible for blowing up his house.

In his demand letter, Mutua noted that the video containing the libelous content circulated widely within Kenya and across the World  

“The said publication has also been shared online with various social media outlets with your consent and approval and will very likely be archived in social and mainstream media archives section, where any person doing research and or background searches on our client would gain access to the libelous,” the lawyers stated in the demand letter.

The lawyers’ statement also noted that the said words were meant and intended, calculated and understood to injure Mutua’s reputation. 

The lawyers instructed the activist to follow their demands, failure to which they would institute legal proceedings against him.

“That you retract and pull down all of the said libelous and defamatory publications, of and concerning our client in the same prominence as in the offensive publications.” 

Mwangi has also been ordered to publish an apology which is acceptable to the governor in a manner approved by him.

“That at your expense, you publish an apology to our client in wording and manner approved by our client, and in the same prominence as the offending publications,” the demand letter added.

He has also been instructed to pull down the video from the internet and any other web-based resource or archive where the said publication has been stored, posted, or is stored, and provide a certificate to Mutua of such pulling down of the publication. 

Mutua has also demanded that Mwangi undertakes, in writing, that he will not publish any further defamatory material in a similar manner or related to the offending article. 

“Our client will otherwise set in motion the legal process for redress in default of your meeting the terms of the demand as herein demanded and will further seek and pursue ancillary relief and damages at your risk to costs thereof, without any further or other reference to you in this regard," the statement read.
