The Milimani Children's Court has jailed a Dutch national for 10 years after being found guilty of 10 counts of child pornography, sexual communication with a child, indecent acts with a child, and child abuse.
In a statement on Tuesday, March 4, the Office of the Director of Public Prosecution (ODPP) said that the suspect was found guilty of six counts of child pornography, 2 counts of sexual communication with a child, one count of committing an incident act with a child, and one count of child abuse.
"A 73-year-old Dutch national, convicted on 10 counts of various offenses of child pornography, sexual communication with a child, indecent act with a child, and child abuse," ODPP stated
According to the ODPP, the suspect intentionally exposed a 17-year-old minor to obscene audiovisual materials via WhatsApp, to encourage the minor to engage in sexual acts.
The suspect was also found guilty of encouraging a 16-year-old minor to communicate with him sexually.
Furthermore, the court found the individual guilty of unlawfully and indecently touching the private parts of the same minor, thus sexually abusing him on the same bed where the mother who he was in a relationship with, also lay.
The accused was also found to have actively encouraged PW3 to engage in sexual acts with underage girls and instructed him to take nude photos and videos during those acts, which were then sent to the accused.
The offences according to the ODPP, were committed between April 2022 and November 2023.
“As the court of first instance, having heard this matter from the onset, and having observed the demeanor of the accused person and all witnesses with particular emphasis on PW3, who testified from a place of deep hurt this court finds that the prosecution adduced overwhelming evidence in support of all 10 counts. Each charge has been proved both individually and collectively beyond reasonable doubt,” said Hon Alice Macharia during the ruling
According to the ODPP, in addition to the 10 years, the 73 year Old suspect was fined a total of Ksh3 Million in restitution of the victims.
The court has further ordered the deportation of the suspect after he completes his Prison Term.
9 witnesses were presented in the hearing to support the case, according to the ODPP.
