Two men will each serve 28 years in jail after a Kilifi Court found them guilty of defilement.
In a statement on Tuesday, May 27, the Office of the Director of Public Prosecution (ODPP) said the men, aged 21 and 19, defiled the 16-year-old girl on the night of February 9, 2024, at Mwambetsungu village in Kilifi.
"The court heard that the victim had gone out to collect her shoes at 10pm when she was accosted by the two, who were her neighbours," ODPP stated.
According to the ODPP, even though the 19-year-old did not participate in the act, he could either stop what was happening or walk away.
Instead, the 19-year-old held a knife and threatened to hurt the girl, while the 21-year-old covered her mouth and defiled her.
“Having considered the Prosecution's case and defence, the court is satisfied that the prosecution has proved the main charge of gang defilement beyond doubt. The accused are found guilty and convicted accordingly,” Chief Magistrate Charles Obulutsa said in his ruling.
The announcement comes almost two months after the Milimani Children's Court jailed a Dutch national for 10 years after being found guilty of 10 counts of child pornography, sexual communication with a child, indecent acts with a child, and child abuse.
In a statement on March 4, the ODPP confirmed that the suspect was found guilty of six counts of child pornography, two counts of sexual communication with a child, one count of committing an indecent act with a child, and one count of child abuse.
The offences, according to the ODPP, were committed between April 2022 and November 2023.
According to the ODPP, in addition to the 10 years, the 73-year-old suspect was fined a total of Ksh3 Million in restitution to the victims.
The court has further ordered the deportation of the suspect after he completes his Prison Term.
"A 73-year-old Dutch national, convicted on 10 counts of various offenses of child pornography, sexual communication with a child, indecent act with a child, and child abuse," ODPP stated.
