Gachagua Does Not Enjoy Any Immunity Against Prosecution, Says DCI Amin

Former Deputy President Rigathi Gachagua will be prosecuted like any other Kenyan if he is found to have any connections to the violence that erupted on June 25, DCI boss Amin Mohammed has confirmed.

Amin made the remarks on the afternoon of Monday, June 30, during a press briefing to provide updates on the investigations, five days after protests turned violent in several parts of the country.

During his brief, the DCI boss was questioned on the plausibility of Gachagua facing prosecution in the event he was found to be a person of interest in the protests.

According to the DCI boss, no one was immune to prosecution, and the former deputy president would face the full force of the law if investigations tied him to the Wednesday violence.

"With regard to Rigathi, I would like to put it very clearly that Rigathi Gachagua does not enjoy any immunity against prosecution. He is subject to the laws of the land," Amin said.

Amin, however, clarified that no summons were made against Gachagua. 

'If, in our investigations, he is found to have been involved in criminal activity, then action will be taken against Rigathi Gachagua."

The DCI boss further revealed several notable findings from the investigations so far, including that the violence witnessed in various parts of the country, including Nairobi, was by design and not random.

"Our investigations have uncovered disturbing incidents. There has been destruction of critical government infrastructure. Several firearms and police equipment were stolen, and some of these weapons have already been used in violent robberies," Amin went on.

"These actions were not spontaneous; they were orchestrated, and we are actively pursuing the mobilisers and financiers of these acts, and they will be brought to justice soon."

Gachagua initially spoke on the June 25 protests on Thursday, where he called out the state for allegedly using excessive force to quell protesters.

The former DP alleged a well-orchestrated plot to block protesters along Kiambu Road and Thika Road to leave them stranded while goons wreaked havoc in the Nairobi Central Business District.

The Democracy for Citizens Party (DCP) leader spoke on the looting that was witnessed in the Nairobi CBD, alleging that specific businesses were deliberately targeted.

During Amin's press conference on Monday, he called on victims of the violence, including those whose property and shops were damaged, to come forward to aid in investigations.

As of Monday, June 30, the DCI confirmed 485 people had been arrested in connection with the chaos witnessed in various parts of the country. 448 suspects have already been charged, while 37 are still under investigation.
