Kenyan Couples Married Under Customary Law Told to Obtain Marriage Certificates

All Kenyan couples married under the African customary law have been asked to register their union with the Registrar of Marriages.

A Kenya Gazette notice dated June 9 stated that marriage certificates would be issued to parties upon successful completion.

"The Registrar of Marriages wishes to inform all parties married under African customary law that they are required to register their marriage starting 1st of August, 2017," the notice read in part.

Couples planning to marry under the customary law from 1st August were asked to obtain prior authorization from the Office of the Registrar of Marriages.

According to section 96 of the Marriage Act, Kenyan couples considered to be married under the customary law are those who formalised their marriages by cohabiting or by way of elopement.

It is, however, important to note that under Customary Law, the marriage is considered to be formal if the bride price is paid in full.
