Justice George Odunga Declines to Refer Wavinya Ndeti's Case to Another Judge

Machakos County Gubernatorial Candidate Wavinya Ndeti on Wednesday got a boost after High Court Judge George Odunga declined to refer her case to another judge as earlier requested by the Independent Electoral and Boundaries Commission (IEBC).

In his ruling, Judge Odunga noted that the IEBC's petition did not meet the tests required and as such he could not hand over the case to another judge.

"The application does not meet the test for me to recuse myself from the case," Justice Odunga stated.

On Tuesday, IEBC had filed an application stating that Wavinya's case should be heard by another Judge.

IEBC filed the petition after Judge Odunga on Friday suspended an earlier decision by the Commission to bar Wavinya from the gubernatorial race.

Judge Odunga directed the IEBC to allow Wavinya to run for the seat pending determination of her appeal.

Wavinya has in the past few weeks faced a series of petitions with the latest being a case where IEBC nullified her nomination on grounds that she was a member of two political parties.

The former Kathiani MP is seeking to be the next Machakos County Governor and will face off with incumbent Governor Alfred Mutua who is vying on a Maendeleo Chap Chap ticket.
