Nairobi High Court Orders Jubilee to Conduct Fresh Nominations in Budalangi Within 3 Days

The Nairobi High Court on Tuesday ordered the Jubilee Party to conduct fresh nominations for the Budalangi Parliamentary seat within three days. 

The Court quashed an earlier decision by the Political Parties Dispute Tribunal (PPDT) to cancel the nomination certificate issued by Jubilee Party to Alfred Juma Maloba and instead awarded it to his rival Mediatrice Wangira.

Justice Jessie Lesiit in her ruling stated that the party would be required to conduct fresh primaries in compliance with its Constitution and Elections Act.

Mr Maloba had petitioned the court to issue orders compelling the party to award him the nomination certificate but was shocked to learn that Wangira had filed a complaint with the PPDT.

In the nominations, Maloba had garnered 5,569 votes against Wangira’s 5,489 votes.

He was duly issued with the nomination certificate dated May 9 but later learned that the party had not forwarded his name for clearance by the Independent Electoral and Boundaries Commission (IEBC) pending the dispute at PPDT.

The order to conduct fresh nominations in Budalangi comes barely a week after the Court of Appeal ordered the Jubilee Party to re-do nominations in Kitui South Constituency.

The Court quashed the nomination of  Member of Parliament Rachael Nyamai as the Jubilee candidate for the Kitui South parliamentary seat after an appeal was filed by her rival disputing the outcome of the exercise.
