NASA Files Appeal Over Evidence Linking President Uhuru Kenyatta to Al-Ghurair

The National Super Alliance (NASA) has filed an appeal against the High Court decision on the Presidential ballot paper printing tender.

In their appeal, NASA argues that the three-judge bench of the High Court declined to appreciate evidence linking President Uhuru Kenyatta to Al-Ghurair.

Last week, the Judges noted that newspaper cuttings showing President Kenyatta shaking hands with a delegation from the Dubai Chamber of Commerce could not be used as sufficient evidence to prove that the two met to discuss ballot tender issues.

NASA's appeal comes only three days after the Independent Electoral and Boundaries Commission (IEBC) filed an appeal against the High Court ruling.

In their appeal, IEBC wants the court to quash the High Court's ruling cancelling the ballot paper printing tender awarded to Al Ghurair.

According to the polls body, there is no time to float the tender a fresh as there are only 28 days remaining before the General Election.

“The learned judges erred in fact when they found that there is still time available to the appellant to procure election material without any factual basis and disregarding the professional assessment of the appellant,” IEBC's appeal reads in part.

NASA wants the ballot papers tender be awarded to another firm.
