The ODM Party is reportedly working on a plan to replace Kenya National Union of Teachers (KNUT) Secretary General Wilson Sossion with outgoing Bomet Governor Isaac Ruto in its nominees to the National Assembly.
In a letter written to IEBC, the party wants the electoral commission to substitute Sossion with Mr Ruto in the parliamentary position.
Reports further indicate that ODM intends to make Ruto the minority leader in the National Assembly a position previously held by Kitui West Legislator Francis Nyenze of the Wiper Democratic Movement.
Officials of ODM, while speaking to the Nation, confirmed that the matter had been brought up at meetings but was not received well by some members.
"A section of the party’s leaders are of the feeling that the proposal is legally untenable," the officials who sought anonymity stated.
They added: “We know it is not legally possible but let us wait for the IEBC response.”
The move could, however, prove to be futile as the Elections Acts clearly states that “A party list submitted shall not be amended during the term of Parliament or the county assembly, as the case may be, for which the candidates are elected.”
Mr Ruto, one of the National Super Alliance (NASA) principals, lost his gubernatorial seat to Deputy Speaker in the National Assembly Joyce Laboso with a landslide.
The outgoing Governor was also counting on being appointed as deputy premier Cabinet Secretary in case NASA won last week's General Election.
