Supreme Court Directs NASA's Raila Odinga and IEBC to Submit Written Submissions on Presidential Petition

The Supreme Court of Kenya has directed Opposition leader Raila Odinga to submit a written submission supporting his petition by 1 pm on Friday, August 25th.

Speaking on Monday, Chief Justice David Maraga instructed Mr Odinga to file the submission to explain why his petition challenging the re-election of President Uhuru Kenyatta should proceed.

The respondents in the petition, President Uhuru Kenyatta, the Independent Electoral and Boundaries Commission (IEBC), and its Chairman Wafula Chebukati have also been ordered to present their submissions on the same day by 7 pm explaining why NASA’s petition should be thrown out.

“Should petitioners wish to file a rejoinder to the respondent’s written submissions, they should file and serve the same by 9 am on August 26 (Saturday),” the Chief Justice added.

The CJ further directed that any party seeking to file an application relating to the petition to also file a no more than five-page submission by Friday.

On Monday, the Supreme Court of Kenya made two new discoveries on the petition filed by the National Super Alliance (NASA) challenging President Uhuru Kenyatta's re-election.

According to the court, four documents in Opposition leader Raila Odinga’s petition were filed after the deadline set for Friday midnight.

The court’s registrar, Ms Esther Nyaiyaki, in a letter to Mr Odinga’s lawyers on Monday noted that NASA lawyers submitted additional volumes of their evidence numbered Volume 60, 61, 62 and 63 on Sunday after the deadline.
