Chief Justice David Maraga Orders Report on Access to Election Servers

Chief Justice David Maraga has hit the Independent Electoral and Boundaries Commission (IEBC) with a tough order ahead of the report on access to election servers expected at 5 pm.

Speaking on Thursday at the Supreme Court, Maraga ordered lawyer Paul Muite to communicate with his clients and ensure the court had a report by Tuesday evening.

This is after Muite had stated that the servers to be accessed were in Europe and people working for the unnamed service provider were still asleep hence could not avail the report on access in good time.

"At 5 o'clock we want a report. Anyone who will not have complied with the order will have to tell the court why.

"Even if your clients are in Europe, then wake them up and comply with the orders," ordered CJ Maraga.

He further instructed the Supreme Court to increase staff scrutinising select poll documents at Milimani courts to ensure the exercise ends on time.

Earlier on Tuesday, NASA lawyers had accused IEBC of denying them access to the servers more than 24 hours after the Supreme Court ordered the scrutiny.

“We've been stonewalled. No read only access. They want to give already printed logs. It's back to court in the morning,” NASA lawyer Paul Mwangi lamented.

The NASA lawyers said that their agents, as well as those of Jubilee, stayed at IEBC offices until 4.30am on Tuesday as they waited to be granted the court-ordered access to no avail.

In a counter reaction, IEBC claimed that it had complied with orders issued by the Supreme Court.

“The commission has complied with orders as framed the Supreme Court. All parties in the petition are going on with the scrutiny,” IEBC also said on its official Twitter handle.
