Jubilee Party Enjoined in New Petition Against IEBC

The Jubilee Party has been enjoined in a case in which three voters want the Independent Electoral and Boundaries Commission (IEBC) top officials fired and declared unfit to hold public office.

The three petitioners, Brian Asei, Ben Wanasakami and Kevin Olwanga also want the IEBC stopped from conducting the fresh presidential elections it had set for 17th October.

High Court Judge John Mativo has directed the three petitioners to serve the Jubilee Party with the papers.

The respondents and applicants are expected to appear in the High Court for hearing next week on Wednesday.

The three individuals argue that the IEBC failed to serve Kenyans and should be barred from supervising any general election, specifically the fresh presidential poll ordered by the Supreme Court.

In the petition, they also argue that the electoral officials led by Chairman Wafula Chebukati and CEO Ezra Chiloba are guilty of violating the constitution by holding a faulty election.

Following the Supreme court decision that stated the election was not conducted transparently, the individuals also want the top bosses declared unfit to hold any public office.

Besides Chebukati and Chiloba, the six IEBC commissioners including Consolata Nkatha, Bucha Maina, Boya Molu, Roselyn Akombe, Paul Kurgat, Margaret Mwachanya and Abdi Guliye have been named as respondents.

Meanwhile, National Super Alliance (NASA) presidential candidate Raila Odinga has announced that he would like the repeat presidential election be held on either October 24 or October 31.

Mr Odinga has maintained that the October 17 date given by the Independent Electoral and Boundaries Commission (IEBC) was not consultative, adding that the date had been decided by the Jubilee Party.
